Group Five Privacy Policy

This privacy policy (“Policy” or “Privacy Policy”) is posted by Group Five Inc. (“we,” “us,” “our,” or “Group Five”), and governs the use of groupfiveinc.com, including all webpages and surveys hosted under that domain name (the “Site”), as well as research services (the “Services”) provided by Group Five to our clients (“Clients”).

We’ve developed this Privacy Policy to describe (1) how we collect, use, transfer, and store information of individuals who participate in research or visit the Site (“you” or “your”); (2) your choices regarding your information; and (3) how we ensure your privacy and the privacy of our Clients.

Our privacy practices are compliant with applicable data protection and privacy laws, including the California Consumer Privacy Act (“CCPA”). We strive to make our website, including this Privacy Policy, accessible to individuals with disabilities. By using the Site and/or the Services, you consent to the terms of this Policy, which forms a binding agreement between you and Group Five. If you do not agree with this Policy, do not use the Site or the Services. Continued use of the Services and the Site constitutes your freely given, specific, and informed consent and agreement to the collection and use of your personal information.

 

Collection of Personal Information

As used in this Policy, “personal information” means any information relating to an individual that can be used to identify that individual either on its own or in combination with other readily available data. We may collect personal information for the purpose of conducting market research, as expressly stated and agreed to by you, and as otherwise provided in this Privacy Policy.

Browsing Information

You can visit most of our Site without submitting personal information to us. However, when you visit the Site, we may automatically collect general technical user data, such as your device’s Internet Protocol (“IP”) address, operating system and browser type, and the date and time of your visit.

Cookies

A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive. As part of offering and providing customizable and personalized services, we may use cookies to store and sometimes track information about you. Group Five does not use cookies, but we have relationships with third party websites that may use cookies, so we urge you to review the privacy policies of such third party websites. Information You Actively Submit

In order to engage with us beyond simply surfing the Site (inquiring about our Services, for example, responding to surveys, subscribing to email updates, downloading research reports or filling out the “Contact Us” form), you may be required to provide information such as your name, email address, mailing address, and company affiliation. In each case, you know what information we collect, because you will actively submit the information.

Information We Receive from Third Parties

We may also receive information, including personal information, from third parties who have previously collected such information from you. For example, we receive personal information from financial services companies, including transfer agents, global stock plan administrators, equity compensation service providers, and their corporate clients, in order to request your participation in surveys.

Business Information

We may collect employee contact names, addresses, phone numbers, and email addresses of our business partners, including suppliers and vendors, for the administration of our business relationships with Clients. If you feel that your personal information is being collected inappropriately, please contact us as provided in the “Your Choices” section below.

Use of Your Personal Information

We use your information to operate, evaluate, and improve our business, including for such purposes as developing new products and services, managing our communications, and analyzing our Services.

If you provide us with your name and contact information, we will use this information to answer requests from you, invite you to participate in research, communicate with you regarding any Services we are providing to you, and inform you about additions to our Services.

Sharing of Information with Third Parties

We may share information associated with your name as follows: (1) with your consent; (2) with service providers who help deliver our Services, subject to confidentiality agreements; (3) as required by law; (4) to protect you, our business, or third parties from harm; or (5) in a reorganization or sale of our assets, subject to the acquirer accepting the commitments made in this Policy and in compliance with applicable law.

Your survey responses are kept confidential and combined with those of other respondents for the purpose of creating aggregated, market research reports and analyses. If you receive one of our client-branded surveys that Group Five sends on behalf of its clients, your individual responses will also be shared directly with such clients.

We do not share your information with any third parties for marketing purposes.

If you are visiting the Site or participating in one of our research studies from a country other than the U.S., your communications with us will result in the transfer of information across international boundaries. By visiting the Site and communicating with us, you consent to such cross-border transfers.

Notice to California Residents

Under CCPA’s broad definition, “personal information” may include (in addition to names, addresses, and the like) unique identifiers, IP addresses, biometric information, internet or other network activity (such as browsing history, search history, etc.), geolocation data, audio/visual data, and even inferences which may be drawn from any of the above.

CCPA also defines the term “sell” broadly. Its meaning includes “renting, releasing, disclosing, disseminating, making available, [and] transferring…for monetary or other valuable consideration.” Under this definition, and the CCPA’s broad definition of “personal information,” we may “sell personal information” about you to our clients or other partners.

Your Right to “Know” and to Request Deletion

You have the right to know the categories and specific pieces of personal information we have collected about you. You have the right to know the categories of sources from which the personal information has been collected, the business or commercial purpose for collecting or selling personal information, and the categories of third parties with whom we share personal information. You have the right to request deletion of personal information we’ve collected or maintain.

We may ask you to provide additional information, such as your full name, birth date, phone number, email address, or other basic personal information about you that we already have on file, in order to verify who is making the request. Please note that any requested disclosures will only apply to the 12-month period preceding the request, and you are entitled to request disclosure regarding your personal information twice in any 12-month period.

Your Right to Opt Out

Your Right to Non-Discrimination

You have the right not to receive discriminatory treatment for the exercise of the privacy rights conferred by the CCPA, including but not limited to by denying you services, charging different prices or rates, or providing you with a different level or quality of services.

Your Right to Use an Authorized Agent

You have the right to designate an authorized agent to make a request under the CCPA on your behalf. To designate an authorized agent, please contact us as provided below. In order to verify you have authorized an agent we will require a signed, written authorization from you.

Categories of information we’ve “sold” in the previous 12 months include: individual transaction IDs and transaction codes.

Categories of information we’ve otherwise disclosed for a business or commercial purpose (for example, for confidential use by our service providers) in the previous 12 months include: Name, mailing address, e-mail address, postal code, and control number (unique survey ID).

INFORMATION ACCURACY & RETENTION

We make efforts to ensure that personal information we receive or maintain is accurate and complete, but we rely on the accuracy of the information provided directly to us.

In general, we keep personal information as long as we need it to provide our Clients the Services they have requested. However, we reserve the right to retain personal information for any period required by law, or to comply with our legal obligations, resolve disputes, and enforce our agreements.

PROTECTION OF PERSONAL INFORMATION

Group Five uses reasonable security measures to prevent loss, misuse, and alteration of information under our control. However, we cannot guarantee the security of information on or transmitted via mail or over the Internet. We rely on various security methods and systems to ensure the secure storage and transmission of data.

If we learn of a security breach, we may attempt to notify you electronically so that you can take appropriate protective steps, by posting a notice on the Site, and/or by sending an email to you at an email address you have previously provided to us.

The Site may contain links to third-party websites. We do not have control over the security practices of such third parties. Any personal information you provide to a third party is subject to that third party’s privacy policy. Please learn about the privacy and security policies of such third parties before providing them with personal information.

Your Choices Regarding Your Information

You can choose whether your personal information is (1) disclosed to a third party or (2) used for a purpose that is materially different from the purpose(s) for which it was originally collected. Opt out

If you no longer wish to receive communications from us, you can opt-out by sending an e-mail to info@groupfiveinc.com or using the opt-out link contained in the communications from Group Five. Alternatively, if you receive communications that Group Five may send to you on behalf of its clients, you can opt-out directly with such clients on receipt from any future communications.

Verification process

If you make a request to access or delete your information, or to opt out of the sale of your personal information, we may ask you for additional information to verify your identity. This information may include: your full name, birth date, phone number, email address, or other basic personal information about you that we already have on file. In certain cases, deleting or limiting the use and disclosure of your personal information may impact the functionality or prevent the use of the Site or the Services.

Please be advised that our ability to answer your request is contingent on our ability to identify what information belongs to you. In any case, we will always use best efforts to identify and delete or disclose all personal information related to you.

FINANCIAL INCENTIVES

In addition to providing you with the valuable opportunity to share your views and opinions, we may also provide you with financial incentives as consideration for your participation. By being given the opportunity to participate and by receiving the incentive, you agree that this consideration represents fair value for your participation. Such financial incentives may be rewarded only if the applicable survey, research project, or study is fully and properly completed by the respondent, in the sole discretion of Group Five.

CHILDREN

The Site and the Services are not intended for, and we do not knowingly collect information from, individuals under the age of 16. If we discover that we have unintentionally done so, we will promptly delete such information.

DO NOT TRACK

Some browsers have a “do not track” feature that lets you tell websites you do not want to have your online activities tracked. Because there is no commonly accepted response for “do not track” signals initiated by browsers, we do not presently respond to them. We will, however, treat any "do not sell" signals as opt out requests under CCPA.

YOUR CALIFORNIA PRIVACY RIGHTS

California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the disclosure of personal information to third parties for the third parties’ direct marketing purposes. If you are a California resident and wish to obtain information about our compliance with this law, please contact us as set forth in the “Your Choices” section above. Requests must include “California Privacy Rights Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are not required to respond to requests made by means other than the e-mail address or mailing address provided herein.

DISPUTE RESOLUTION

All disputes arising under this Policy shall be governed by and interpreted in accordance with the laws of California, without regard to principles of conflict of laws. The parties to this Policy will submit all disputes arising under this agreement to arbitration in San Francisco, California, before a single arbitrator of the American Arbitration Association (“AAA”).

The arbitrator shall be selected by application of the rules of the AAA, or by mutual agreement of the parties, except that such arbitrator shall be an attorney admitted to practice law in California. No party to this Policy will challenge the jurisdiction or venue provisions as provided in this section. Nothing contained herein shall prevent the party from obtaining an injunction.

CLASS ACTION WAIVER

Any arbitration or court trial, related to any claim under this Policy, whether before a judge or jury or pursuant to judicial reference, will take place on an individual basis, without resort to any form of class or representative action (“Class Action Waiver”). THIS CLASS ACTION WAIVER PRECLUDES ANY PARTY FROM PARTICIPATING IN OR BEING REPRESENTED IN ANY CLASS OR REPRESENTATIVE ACTION REGARDING A CLAIM UNDER THIS POLICY. Regardless of anything else herein, the validity and effect of the Class Action Waiver may be determined only by a court and not by an arbitrator. THIS CLASS ACTION WAIVER IS VOID WHERE LIMITED OR PROHIBITED BY LAW.

CHANGES TO PRIVACY POLICY

We reserve the right to modify this Policy at any time. If we decide to change our Policy, we will prominently post those changes here and any other place we deem appropriate, so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it.

If we make any material changes, we will notify you either by way of an email or by a notice on the Site. We will use information in accordance with the Policy as it was in effect at the time information was collected.
